Terms of Service

By purchasing and participating in NGLISH programs, you agree to these Terms of Service.

1. Service Description

NGLISH provides English pronunciation and clarity coaching through:

- Live small-group video sessions (maximum 8 participants per group)

- Access to the ELSA pronunciation training app
- Support and guidance via WhatsApp


Important: NGLISH is a tutoring/coaching service. We do not provide official language certifications, level assessments, or academic credentials.

2. Payment and Program Activation

1. Full payment is required before access is granted.

2. Your program period begins upon payment confirmation.

3. No refunds: all sales are final; no cash refunds under any circumstances.

4. Prices may change without notice

5. Charges are billed to your selected payment method; you are responsible for any bank/processor fees.

6. If your payment method changes, you must notify NGLISH to update billing.

3. Attendance and Participation

1. Punctuality: sessions start at the scheduled time and are not extended for late arrivals.

2. Non-transferable / non-cumulative: missed sessions are forfeited, unless a reschedule is approved.

3. Rescheduling (limited): only for significant circumstances, requested in advance, subject to NGLISH review and instructor availability.

4. Performance Tracking and Evaluation

To ensure program effectiveness and validate any guarantee, NGLISH may record/track:

1. Session attendance

2. ELSA usage and progress data

3. Baseline and progress voice samples (recorded)

4. Participation/engagement metrics

By participating, you consent to this tracking for program improvement and guarantee verification.

5. Guarantee Terms

Offer: one (1) additional month of coaching at no charge if improvement criteria are not met.

Eligibility requirements (all must be met):

1. Attend all scheduled live sessions

2. Demonstrate regular, consistent ELSA usage

3. Provide required baseline and final voice samples

4. Complete assigned exercises/activities

5. Maintain active participation throughout the program

Limitations:

1. One claim per customer; non-transferable

2. Subject to instructor availability

3. Must be claimed immediately upon program completion

4. Improvement is determined at NGLISH’s discretion using tracked metrics

6. Technology and Platform Access

Requires a stable internet connection and compatible device.

Technical issues on your side do not qualify for makeups or refunds.

ELSA app: third-party service governed by ELSA’s terms and privacy policy; if downloaded via Apple App Store or Google Play, their terms also apply.

WhatsApp access and an active phone number are required.

NGLISH may update, change, or discontinue technologies/platforms at any time.

7. Intellectual Property and Content

1. All program materials (methods, content, documents, audio, video) are proprietary to NGLISH or its licensors.

2. Recording live sessions is prohibited without written consent.

3. Sharing materials or access credentials with non-participants is strictly prohibited.


8. Privacy and Data Protection

Voice samples and progress data may be used to improve the program and, where required by law, with your consent for testimonials.

Personal information will be handled under applicable privacy laws and our Privacy Policy.

WhatsApp communications are subject to WhatsApp’s terms and privacy policy.

9. Limitation of Liability

NGLISH provides coaching/tutoring services only and does not guarantee:

job placement or career advancement;

immigration or visa outcomes;

academic results or test scores;

a specific timeline for improvement.

To the maximum extent permitted by law, NGLISH will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill.

10. Program Modifications

NGLISH may:

modify program structure or content;

change session schedules with reasonable notice;

substitute instructors when necessary;

update these Terms with notice to participants.

11. Cancellation and Termination

By NGLISH: participation and access may be terminated for:

disruptive behavior;

violations of these Terms;

non-payment, fraudulent payment, or payment disputes;

disrespectful communications;

misuse of platforms or sharing access.

By Participant:

No cancellations or refunds after purchase; all sales are final.

Effect of termination: upon termination, your access to program materials, WhatsApp groups, and ELSA via NGLISH is immediately revoked.

12. Communication Policy

Official communications may be in English and/or Spanish.

WhatsApp is the primary support channel.

Typical response time for non-urgent inquiries: 24–48 business hours.

13. Force Majeure

NGLISH is not liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, widespread technical outages, or government actions.

14. Acceptance of Terms

By purchasing NGLISH services, you confirm you have read, understood, and agree to these Terms of Service. If you have questions, please contact us before using the services.
